Prior to marketing your property you will now need a Home Information Pack (HIP), which can be provided by Heptonstalls.
We will need to prepare an “information pack” about your house for the buyer. This comprises of a; HIP, Property Information Form, Fixtures Fittings and Contents Form, copy of your Title Deeds and the Agreement for Sale.
The first two items, Property Information Form, and Fixtures, Fittings and Contents Form, are filled out by you. The forms contain questions about your house that you should be able to answer quite easily. You shouldn’t need any help filling them in but if you do just let us know.
If you have a mortgage, then your Title deeds will be held by your lender (usually a bank or building society); if you do not have a mortgage then you should know where your own deeds are kept. Either way we will need them so that we can provide the buyer’s conveyancer with a copy. This is to prove to them that you own your house, and to show them any rights of way or other legal rights or obligations that may exist, these are sometimes referred to as incumbrances.
Once the buyer and you as seller are ready, a completion date (the ‘moving date’) is agreed. We will then exchange contracts (this simply means swapping the Contract for sale signed you for one signed by your buyer – together with a deposit provided by the buyer). After contracts are exchanged the contract is binding and neither party can withdraw without incurring potentially huge expenses and costs.
On the moving date we receive the balance of the sale price, in return for which we will hand over the title deeds to the house. We will use the money to repay any mortgage on the house and secondly to pay the costs of sale – the Estate Agent’s account and our own fees. If there is money left over then this will be sent to you on the moving date, unless you are using this money on a house purchase.
