Small Claims Disputes
At one time or another it is common to find yourself in dispute with someone else, whether that be because of money owed to you, faulty workmanship by a tradesman or goods you have bought that do not work properly, for example.
In our legal system the local County Court will deal with all these matters and more. Particularly, if your claim has a value of £5,000 or less then it will be dealt with in the Small Claims Track, which people commonly refer to as the Small Claims Court.
The main difference between the Small Claims Track and the ‘Fast-track’ and ‘Multi-track’ in the County Court is that the system is designed to be much simpler, which allows the general public to pursue their claim themselves, often without the need for legal intervention.
One issue that reinforces this is the ‘no-costs’ rule in the Small Claims Track. This rule, generally, with very few minor exceptions, means that even if you are successful in your claim, that you are not able to recover any legal fees you have spent. You are however entitled to recover any court fees you have to pay out.
For this reason it is often worthwhile speaking to a solicitor initially for a legal perspective on your case and to advise you how best to complete your Claim Form to begin your claim and maximise your chances of success.
